Terms of Service

1. Who may use Apartio

You must be at least 18 years old and able to enter into a binding contract. If you use the Service on behalf of a company or other organisation, you confirm that you are authorised to accept these Terms on its behalf.

Browsing listings does not require an account. Posting listings and managing them does.

2. What Apartio is - and is not

Apartio is a venue that lets sellers publish property listings and lets buyers find them. We are not a party to any transaction, agency, broker, or agent. We do not own, inspect, or guarantee any property, and we do not take part in negotiations, payments, contracts, or transfers between users.

Any dealing you enter into with another user is solely between you and that user. You are responsible for your own due diligence before relying on a listing or contacting a seller.

3. Your account

You are responsible for the accuracy of your account details, for keeping your credentials confidential, and for everything done through your account. Tell us promptly if you suspect unauthorised use.

You must provide a real name and a working mobile number, because buyers contact sellers directly. Giving false identity or contact details is a breach of these Terms.

4. Posting listings

You may post only properties that you are entitled to advertise, and only with information that is true, current, and not misleading. Photos must be of the actual property. You grant Apartio a non-exclusive licence to host, display, resize, watermark, and distribute the content of your listings for the purpose of operating and promoting the Service.

Apartio is built to keep one property to one listing. We detect and may merge, hide, or remove duplicates, and we may review, decline, or remove any listing that appears to breach these Terms or the law. These measures are a service to the marketplace and are not a warranty that every duplicate or unlawful listing will be caught.

5. Acceptable use

You agree not to: post false, fraudulent, or unlawful content; infringe anyone's rights; harvest or scrape data; probe, overload, or disrupt the Service; upload malware; impersonate others; or use the Service to send spam or to break any applicable law, including Georgia's data-protection rules.

6. Communications

The Service sends you messages it needs to operate - email to confirm your address, to reset a password, or about your listings and account. These are part of the Service and are not marketing.

By accepting these Terms you also agree to receive occasional updates from us by email or SMS. You can unsubscribe at any time from your account or through the unsubscribe link in each message; the service messages above are sent regardless, as they are needed to run your account.

7. Intellectual property

Apartio and its software, design, and brand are owned by the operator or its licensors and are protected by law. These Terms grant you no right in them beyond using the Service. You keep ownership of the content you post, subject to the licence you grant in Section 4.

8. The Service is provided “as is”

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, that listings are accurate or lawful, or that any particular result will be achieved.

9. Limitation of liability

To the fullest extent permitted by law, Apartio and the operator are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, opportunities, goodwill, or data, arising out of or relating to your use of the Service - including content you lose, listings that are removed, or dealings with other users.

You are responsible for keeping your own copies of anything important to you. Nothing in these Terms excludes liability that cannot be excluded under applicable law, such as for death or personal injury caused by negligence, or for fraud.

10. Indemnity

You agree to indemnify the operator against claims, losses, and costs arising from content you post, your use of the Service, or your breach of these Terms or of any law or third-party right.

11. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access, or remove content, if you breach these Terms or the law, or to protect the Service or other users. Provisions that by their nature should survive termination - such as those on liability, indemnity, and governing law - will survive.

12. Changes

We may change the Service and these Terms. If we make a material change to the Terms, we will update the version and date shown here and, where appropriate, ask you to accept the new version. Continuing to use the Service after a change means you accept it.

13. Governing law and disputes

These Terms are governed by the laws of Georgia. The courts of Tbilisi, Georgia have exclusive jurisdiction over any dispute arising from them, except where mandatory consumer-protection law gives you the right to bring a claim elsewhere.
